What Changed in January 2026
Starting January 1, 2026, approximately 500,000 enrollees who are lawful immigrants with incomes below the poverty line will see their health insurance premiums increase astronomically when they lose eligibility for PTCs. This change happened while marketplace premiums rose by an average of 26% for 2026—the steepest increase in nearly a decade, compounding affordability challenges.
Broader Restrictions Coming 2027
A million lawfully present immigrants will lose access to marketplace coverage, Medicaid, and Medicare in 2026 and 2027 as a result of H.R. 1 and a new federal rule. Beginning in January 2026, H.R. 1 prohibits lawfully present immigrants with income below the federal poverty level who do not qualify for Medicaid due to immigration status from receiving this financial assistance.
Starting with the 2027 plan year (open enrollment in fall 2026), eligibility for premium tax credits will narrow further. Refugees, asylees, TPS holders, and several other immigration statuses will lose access to PTCs. Only US citizens, lawful permanent residents, Cuban and Haitian entrants, and COFA migrants will remain eligible.
Emergency and State Options
Important change starting October 1, 2026: States will receive reduced federal matching funds for Emergency Medicaid, which may lead some states to limit what they cover or tighten eligibility rules. However, as of April 2026, seven states, including DC, have also expanded fully state-funded coverage to some income-eligible adults regardless of immigration status.
Critical Action for Immigrant Residents
If you are lawfully present but not a green card holder, citizen, or COFA migrant—whether on a work visa, student visa, asylum, TPS, or refugee status—the open enrollment period in fall 2026 may be your last opportunity to secure subsidized coverage before 2027 changes take effect. Enroll before December 15, 2026. After that date, you will need to pay full price for Marketplace plans or explore state-funded programs in your state.
