F-1 and J-1 Student Visas: Duration of Status Ends, New Time Limits Apply
International students on F-1 and J-1 visas can no longer rely on 'Duration of Status'—a rule allowing them to stay as long as their program continues. As of September 15, a fixed expiration date now appears on their I-94 card, and extensions require USCIS approval.
The Rule Change
On July 17, 2026, the U.S. Department of Homeland Security published the final rule eliminating Duration of Status (D/S) for F and J nonimmigrants. The rule took effect on September 15, 2026.
The rule replaces D/S admissions for F and J nonimmigrants with a fixed period of admission on the Form I-94 record that reflects the F or J program end date, plus a grace period of 30 days. F-1 students and J-1 exchange visitors are now required to file an application for program extension directly with USCIS if they need to stay in the U.S. beyond the expiration date on their Form I-94.
What You Must Do Now
If you are an international student on an F-1 or J-1 visa, mark your calendar carefully. Your authorized stay is no longer open-ended. The grace period has also shrunk: the 60-day grace period for F-1 students has been decreased to 30 days. If you plan to extend your studies, apply to USCIS well before your I-94 expiration date. Overstaying can result in deportation and permanent bars to future U.S. immigration. Contact your designated school official (DSO) or exchange visitor advisor immediately to understand your personal timeline and extension process.
